These Terms of Service (“Terms”) govern your use of the Vibrations mobile application (the “App”), provided by Day One Foundry LLC (“we,” “us,” or “our”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
You may use the App for your own personal, non-commercial use. If you are under the age of majority where you live, you may use the App only with the involvement of a parent or guardian.
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control. You may not copy, modify, distribute, sell, lease, reverse-engineer, or attempt to extract the source code of the App, except to the extent this restriction is prohibited by applicable law.
Vibrations offers original affirmations and guided manifestation practices, including scripting, the 369 method, visualization, bedtime sessions, and gratitude. The App’s content, design, text, and arrangement are our intellectual property and are provided for your personal use only. Vibrations is offered for inspiration, motivation, and general well-being. It is not a substitute for professional medical, psychological, financial, or legal advice, and it does not promise or guarantee any particular outcome or result. If you are struggling, please reach out to a qualified professional.
Vibrations offers an optional “Plus” upgrade as an auto-renewing subscription (offered on a monthly and an annual basis, with the annual plan including an introductory free trial) and as a one-time “Lifetime” purchase. Payment is charged to your Apple Account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel your subscription, and turn off auto-renew, in your Apple Account settings. Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable. All purchases are processed and any refunds are handled by Apple in accordance with Apple’s terms; we do not process payments directly.
You agree to use the App only for lawful purposes, and not to misuse, disrupt, or attempt to gain unauthorized access to the App or its systems.
The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted or error-free, or that any content will achieve a specific result.
To the fullest extent permitted by law, Day One Foundry LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of or inability to use the App.
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the App after an update means you accept the revised Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
